ProtectyourSpex Policy Terms and Conditions

You can have full peace of mind when dealing with Protect your spex for the following reasons:
A. Definitions
The following words and phrases are shown in Italics throughout this certificate; their meanings are shown after them:Administrator – Adminicle Ltd, Callidus House, Cirencester Business Park, Love Lane, Cirencester, Gloustershire, GL7 1XD.
family – you, your spouse, partner, children or parents who permanently live in your home. insured glasses – the prescription glasses you have purchased and for which ProtectyourSpex insurance was purchased, as specified on your policy schedule.
our – belonging to us.
UK – Great Britain, Northern Ireland, the Channel Islands and the Isle of Man.
we, us - Bankers Insurance Company Limited.
you – the person named on the schedule.
your – belonging to you.
What is insured
For 12 months from the date you receive the insured glasses, we will repair or replace them in the event of:- Accidental Damage providing that there is visible evidence that an external force has been applied.
- Loss
- Standard perils, damage or destruction caused directly by:
- Storm, flood, lightning, earthquake, fire, smoke or explosion.
C. Policy Conditions
To be protected under this policy you must be aged 16 years or over.- It is a condition of this policy that the required premium has been paid for the insured glasses.
- You must take all reasonable steps to protect your insured glasses and prevent loss or damage.
- If a claim is fraudulent, fraud is suspected in any respect, or any false information is supplied in relation to any claim, all benefits under this policy will be forfeited and you may be liable to criminal prosecution.
- When you make a claim you must give the Administrator all the evidence and documentation that they need to prove your claim. You will have to pay any cost involved in doing this. You must give the Administrator this evidence in the way they ask.
- An excess is payable for all agreed claims. The excess amount is 10% of the original purchase price of the insured glasses.
- We will repair or replace your insured glasses to the maximum liability specified in your certificate of insurance, less the policy excess.
- We will replace the insured glasses a maximum of twice within any 12 month period.
Cancellations
You may cancel this policy at any time by writing to the Administrator. If you do this within the first 30 days, you will receive a full refund.If you cancel this policy after the initial 30 day period you will be entitled to a pro rata refund again by writing to the Administrator. This means that a refund will only be given for every complete month of the policy remaining, from the date you request the policy is cancelled.
For example, if you request that your policy is cancelled anytime during the seventh month, you will be entitled to a refund for the remaining full 5 months. This will be calculated as 5/12th of the premium you have paid as follows:
The premium taken for a policy is £19.99, therefore the refund would be £19.99/12 x 5 = £8.33
We will not backdate any cancellations and you are unable to cancel this policy if a claim has been made.
E. Law Applicable to Contract
Under the relevant European Community and UK legal provisions you can choose which law covers this insurance, but unless we agree otherwise, English law will apply.The Administrator offers this cover as agents for Bankers Insurance Company Limited, incorporated in England no 2341082, whose registered address is: 117–119 Whitby Road, Slough, Berkshire, SL1 3DR.
F. Claims
To make a claim please telephone the Administrator on 01285 886666 as soon as reasonably possible, who will advise you on how to proceed. All claims must be made within 30 days of the incident. Failure to do so may invalidate your claim.G What is not insured
You can not make a claim for damage or destruction caused by or arising from:- any process of cleaning, restoration or alteration;
- damage caused by or during the execution of any criminal act by you;
- malicious damage caused by you, your family or any person lawfully on your premises;
- any defects for which the manufacturer or supplier is liable.
- any consequential loss;
- due to a change in your prescription being diagnosed;
- due to any cosmetic damage;
- carried out by anyone other than a repairer authorised by the Administrator.

We and the Administrator care about the service we provide to you and make every effort to maintain the highest possible standards. If you have any questions about your policy please ask the Administrator. Please have this document available so that your enquiry can be dealt with efficiently.I Complaints Procedure
Although we set ourselves high standards, if we do not meet your expectations and you are not satisfied in some way we would like to know. Step2 If you are still not satisfied with the way your complaint has been dealt with, you can ask the Financial Ombudsman Service to review your case. You can contact him at the following address: South Quay Plaza, 183 Marsh Wall, London, E14 9SR. Telephone Number: 0845 080 1800.
In order for the Financial Ombudsman Service to review your case, you must send your complaint to them within 6 months of our final correspondence to you.

You are advised that any telephone calls made to our administration and claims handling units may be monitored or recorded. This is to monitor the accuracy of information provided by our customers and our own staff. It may also be used to provide additional training to our staff or to prove that our procedures comply with legal requirements. Our staff are aware that conversations can be monitored and recorded.ProtectyourSpex insurance is underwritten by Bankers Insurance Company Limited incorporated in England no. 2341082. If we are unable to meet our liabilities, you may be entitled to compensation from the Financial Services Compensation Scheme (FSCS) who can be contacted at: 7th floor Lloyds Chambers, Portsoken Street, London, E1 8BN.The first £2,000 of an insurance claim or policy is covered in full through the FSCS, plus 90% of the balance.

As required by the Data Protection Act 1998, we follow strict security procedures in the storage and disclosure of information, which you have given us, to prevent unauthorised access.
Personal Data
Protecting your privacy is important to us. To the extent that personal data or sensitive personal data is processed about you, we will employ appropriate security measures given the nature of the data. We shall try to ensure that your details are accurate, kept up to date and we will not keep your data for longer than is necessary.
Use of Your personal data
The information you supply will be used (i) to administer and process your insurance policy, (ii) to keep you informed of changes to insurance products you bought, (iii) for internal analysis and research, and (iv) to identify you when you contact us.
Sharing of Information
We will not disclose your personal information without your consent, except in limited circumstances as permitted or required by law. We may share your personal information with third party service providers in connection with providing, administering and servicing your insurance policy.
Your Right to Access
